Do you capture at 12 mbps and when you burn the files to DVD do the newer DVD players generally play them OK? If most newer DVD players can handle the higher bitrate that's what I'll use.

Doubt it...
I would stick to the 9.8 limit (including audio)

I use Nero to burn and it drops it down to 9. something. Lately I stopped capturing at 12 mbs because honestly, I could not see the difference between that and 8 mbs, plus trying to archive an hour or so file captured at 12 requires a dual layer DVD. Worth it if you could see the difference. Maybe for high action videos you'd want the max, but for most, 8 mbps is fine and writing at 7 mbps also gives excellent quality.

I would stick to the DVD specs: Max of 10080kbps, with Video limited to 9800, so if Video is at 9800 and there are no subs, Audio is limited to 256kbps (small correction for Blue :))
Authoring a non-standard DVD will certainly lead to incompatibilities, even with newer players. It's not just about the drive speed, it's also about the MPEG-2 decoding chips. They are usually not designed to cope with higher bitrates.
