You simply get a "The first frame is not an intra frame!" error message
(BTW: You could have found out that yourself by simply giving it a try ...)

Every file unavoidably starts with an I-Frame. If the very first frame was a P-Frame, which frame should it refer to ??? Nevertheless, if you select only a part of the video file, then the first frame of
your selection might be a None-I-Frame and that's when "Smart Copy" is used.
