Shouldn't make a difference, but then again, I originally switched to ffms2 from dss because of different seek issues created by the latter. Btw, thanks for all the help so far, I feel that I'm close to solving this issue

I did try all of the following with no luck:
-with new mkvmerge:
*remux after first extracting the AAC stream (instead of muxing straight with the original video file)
*remux after first extracting the AAC stream and muxing it into an m4a
*remux after first extracting the AAC and re-encoding it with Nero AAC
-with old mkvmerge:
*remux normally
*same things I tried with the new mkvmerge

That leaves everything down to the video encoding...onto the more lengthly testing.
