I set the avg/min and max values. In this case the max was set to 7000. My DVD Authuring software is reports the file to have a max of 9800 and I get an error that the bitrate of the video it too high. Any clues as to why it does this? I do not have this problem with the Freeware HC012 encoder.

Found a post dated back a few months which says to untick the "for DVD" option. This fixed it. Now it reports the correct Max bitrate.

Your DVD authoring program is "stupid". In CCE with the "for DVD" option checked, rates above 9800 are supposed to be limited to 9800. The value written in the header is just "for information only" and is not guaranteed accurate - your program is taking that value as "gospel".
You can fix the value so that your prog will accept it with a header editor like "RESTREAM", etc.
