oral copyright dissmissal..? does this wave all the bull

About a month ago i heard Micheal Moore quoted on a statement refering to his latest dvd release farehient 4-11. I cant remeber his exact statement, but i think he said that he did not care if people either downloaded his film from peer to peer file sharing, or if it was passed along through means of dvd backups to friends ect. My question is this, does he have the power to do this? At the time of the statement CNN said that the distributer had yet to say a word about it... if they dont care.... and he doesnt care.... does that mean then that it is legit by means of oral dissmissal of copyright law? Are there any other movies out there that a similar dismissal has been made or any movies that have waved copyright laws all together prior to release?

He said the same thing about farenheight 9/11. But it is only valid if he is the one distributing it. Having sold distribution/copy rights to another company his claims hold no sway over the works copyright status. Basically what he is saying is that he has no intention of going after those distributing his work over P2P. Which is nice and all. But it's not as if he would have been the one going after them anyway.

Mr. Moore's statement is typical for him. Controversial and attention grabbing. Yet at the same time sometimes misleading or overstated. The man knows about drumming up publicity.
