View Full Version : Nierle owns me 89Euro and they dont answer?!

Hej!

The case is that in january 2004, I ordered a bunch of DVD+R medias, but they were all shitty discs and my DVD-burner had problems with them so Nierle.de said that I should return the disc and then they would refund the money for the discs and the transport.
I sent the 75 DVD+R in the middle of january and about 2 weeks later they recieved the package. They sent back the invoice of my order and they would refund 75 Euro, but I had paid 14Euro for the transport, so I wrote back and said that the price which they would refund was not including transport. They said I should fax the invoice of delivery, which I did the next day and from that day I havenīt heard a single word from them. I have tried to mail them several times, called them via phone, but they auto-answer says always that their supporters are busy so I have to contact them via mail or try again later, which I have tried for several times, but without luck.
When it didnīt succeed for me to get contact to them, I sent a registered letter the 31/3 and now it is the 18th. april and I havenīt still heard a word from them.

Im totally lost and dont know what to do?!

Do you have any ideas?

post this on all the CD-R/DVD forums for can find.

cdfreaks would be a good place to start. make a big fuss, and send an e mail to Nierle.de, with links to these threads (which are hopefully quite lengthy by then).

e-businesses have died because they screwed their customers.

there's a case of a man who was selling motorcycles online and screwed a customer in a big way (the bike was destroyed in transit). as a result of making noise on biker forums (about 80 forums, total of about 3 million people have seen these threads, 200000 replies or so in them), this guy will never make a dollar selling online again.

they may re-think considering your case if they are going to lose business over it.

i'm not sure if there's a consumer protection agency relevant to germany or the EU. i'm sure doom9 would know. if there is, then tell them about it.

Contact your credit card company requesting refund.
"jointly and severally Liable". Explain the situation enclosing the documents you have. Also send copys to retailer. Make a note of what number and when you call, also how long. Expalin about additional costs incurred, time wasted, annoyance factor. Request reason and explanation as to how this problem has happened and how they will prevent it happening again. Then report back here, with a full web address and name of company, we all like to know who we are dealing with.

Sure I have some ideas. If I were you Iīd either go and see a lawyer especially if you have a legal insurance. If not I suggest you do it yourself. You ordered at a German shop so I assume you are German as well. Get a Mahnbescheid form and after filling it in send it to the right court. You can get help with doing that at your local court house (Amtsgericht). This kind of legal action is very cheap. if you want 89 Euro you will have to pay 12,50 euro for the whole thing. (ofc the 12,50 will be added to what they have to pay you. same goes for postage and every other costs you may have. naturally they also have to pay your lawyer if you choose to hire one) If you do that chances are that nierle will notice that they canīt fuck with you and simply pay up. With the invoice they donīt stand a chance in a trial anyway.
In case the company will not react youīll have a title against them within 4 weeks. Itīs the cheapest and fastest way to get your money back.

Now they have finally answered my mail. They wrote:

But the delivery costs are only 10 Euro or something and then they still own me 79 Euro, but I dont want to shop there anymore so I wont agree that they pay the delivery costs the next time I order.
I want all the 89 Euro transfered to my account, which I just have sent a mail about. Now I have to wait and see what they write back.

L84work: Im from Denmark, but if they start ignorring my mails again and I dont see the money on my account soon, then I must hire a lawyer. Think I will talk with my parents about that.
