I have a problem with the menus getting cut at the top and the movies get cut on the side, how could I fix this, is there a Resolution that I should be encoding in and making the menus in, i'm currently using 720x480 NTSC standard, right?

You should make sure that you stick to action-safe and title-safe areas on the screen you are developing. Action safe areas are 10% reduction on the screen boundries (36,24 to 684,456). Title-safe are 20% reduction on the screen boundries (72,48 to 638,432). All TVs are different at what they can display, so these are safety zones that should cover all TVs.
Note:
(xx,yy to xxx,yyy) these are X/Y coordinates for the screen.

How can I make these changes? Make the movie with these params and the menus with the params?

Depends on what you are using to make the menus and/or the videos with.
If you are using a paint program (ie Photoshop) to do the menus, just make sure you don't go over those boundries.
I had some problems with an AVI: the hardcoded subtitles were below the safe areas, so I loaded them into Virtual Dub added the resize filter, and put a black mat around the video, then encoded it with TMPEG to DVD specs.
