ok UpperField uncheck in the Encoder tab for CCE solves the jerky problem with concert dvds and documentaries, etc. So I've kept it unchecked and encoded a couple of regular NTSC movies and voila works great. So I'll keep on encoding with it unchecked but I doubt I'll encounter a problem (so far it seems that way). If anyone has ever encountered a case where it's needed please report your findings.

from CCE manual:
Upper field first default on
Specify whether the upper field or the lower field is displayed first when the encoded stream is displayed on an NTSC monitor. This setting can be done in the video setting screen.
If Upper field first is selected, the upper field is displayed first.
Whether this should be selected depends on the configuration of the original file to be encoded, but if this is uncertain, select upper field. If this setting is incorrect, the movement of a encoded video will be jerky.

MB, if you get a chance look in the greedyHMA thread in AviSynth. I seem to remember Tom came up with a quick test to verify field priority. It may be in the greedyHMA download.
