jm decoding errors on x264 encodes

I did some tests with the H.264 reference decoder (jm 19) and stumbled upon problems when decoding x264 ES output.

Test 1:
RefPicList0[ num_ref_idx_l0_active_minus1 ] is equal to 'no reference picture', invalid bitstream

Test 2:

What is the reason for these errors?
- user error on my end?
- bug in this version of jm?
- bug in x264?

Decoding of these bitstreams in ffmpeg or MPC-HC/LAV seems fine. Profile is 4:4:4 Predictive.
