remux seamless branching playlist when files referenced more than once

I have a playlist where a file is referenced more than once

ala

file | in | out
1 | T0 | T5
2 | T0 | T5
3 | T0 | T5
1 | T5 | T7
3 | T5 | T6

every tool I've looked at when trying to remux this to an mkv (mkvtools, tsmuxer, dvdfab....) seem to just append files 1,2,3 in order in their complete size without regard to the in/out time.

Does anyone know of a tool that does this correctly?
