Is it true that we will have to pay money for using x264?

Royalties to be paid by end product manufacturers for an encoder, a decoder or both (“unit”) begin at US $0.20 per unit after the first 100,000 units each year. There are no royalties on the first 100,000 units each year. Above 5 million units per year, the royalty is US $0.10 per unit.

that's why vlc don't release the build (the same for xvid..) but only source code

Read the actual terms for the "money paying". Are you giving out more than 100000 copies of x264? Are you distributing videos longer than 12min in length? Do you have more than 100000 subscribers to a service? Do you run a internet broadcast service in 2011 already?
