Discussion of personally recorded OTA content: Rule 6 violation?

I'm a big History Channel Modern Marvels fan. I've recorded nearly 100 episode on my DVR that I am in the process of archiving for my own personal enjoyment. AFAICT, I obtained this material legally, and am not in violation of any copyright with my personal use.

Is discussion of editing/processing/encoding this material allowable on the forum, or is it a Rule 6 violation?

You do not hold the copyright or a license for it. From what I understand, you may archive it for timeshifting but not to keep forever (making it a rule 6 violation). IP attorneys may have different views.

TV captures are often discussed on this board, just look at the Capturing and Editing Video (http://forum.doom9.org/forumdisplay.php?f=67) section of the forums.

Of course it is allowable IMHO - why else would we have a forum for Analog Capture and one for DVB/ATSC? I also don't buy the 'keep forever thing' - what else is the point of removing logos etc. other than to archive it?

No it's not. Sony vs Universal - the right to timeshift? I don't think the ruling ever said you had to delete the file after having watched it once or twice or whatever.

Anyway OTA recordings are regularly discussed here - whether you're allowed to keep it forever or not may differ in each country but it is in the scope of this forum as far as I can see.

Please let me clarify.

I have never said it is not legal or within forum rules to capture from TV. What I did say is if you do not own the copyright or a license, to the best of my knowledge (and I am not an IP lawyer), you can't hold on to it forever.

And yes, the Betamax case is significant. But timeshifting doesn't last forever; it logically has a period after which you have copied material to which you do not have a license.
