final output gets desync and with weird skips in audio stream.
mkvmerge refuse to merge back to mkv.
would I have to extract with mp4box and remerge in mkv?

Sounds like the easiest and safest options for now, unfortunately (unless there are other transcoders you are able to/would like to use)
