I recently made a DVD out of a TV capture (Oasis Live at Argentina) and the final size of the project ended up at 4576MB. Even though Nero can overburn DVDs up to 4600MB, the previous two tries (an actual burn and a simulation) failed. I'd like to know which programs would you recommend me to use on this particular situation.

Such a small amount - be safe and shrink it with DVD Shrink.

That's a great idea, the main menu has a background movie that's choppy in some spots and that might be due to either the failed burn or too high a bitrate. What if I don't want to transcode/re-encode anything though? What other programs than Nero would you recommend me?

You really don't want to overburn a DVD, as the odds of a successful (proper playback) burn are quite low.

I'd suggest you either edit out less than couple of hundred Megs, or follow the previous suggestion to simply compress with DVD Shrink...
