I found a application jhymn that does just that but it uses lame 0.96 and I would like to use '3.97 (beta 2, Dec 22 2005)' using the new vbr mode. How can I do that?

JHymn (http://www.hymn-project.org/download/JHymn_0_9_2_win.zip) can decode the DRMed AAC file to .wav and then you can use any other program to encode to LAME 3.97b2 (http://audio.ciara.us/rarewares/lame3.97b2.zip).

The problem here is I lose the tag info.

Use JHymn to create an mp4 file without the DRM. Then use foobar2000 to convert it to MP3. foobar2000 can use just about any CLI, and can use custom profiles, so it can use any LAME parameters you want. It supports single-file conversion or batch file conversion. It's free, and it will keep the tag info.
