Looks like from the .pdf she has a good chance, but what i don't understand is why hasn't the RiAA decided to pay her off yet? Have they not decided to pay her off because they think they can win? Have they not paid her because she demands a jury trial? All in all, i hope she sue's and wins. i'm not a lawyer, but it would seem she would get a very good settlement. And what about these companies they hire to illegally break into your computers like that, surely there will be more than just one in the future.

Which ever company that does break into your computer to do whatever they want illegally, even if they get the wrong ip address (because of DHCP or whatever), they are still breaking into that harmless ip, making these companies more harmfull than anything on the victims computer.

Just thought i'd make a post, because we all know the RiAA is corrupt as anything can be, but these companies they hire seem very, very, VERY communist and corrupt. This kind of press for the RiAA is something they have to expect now and forever, but even though any kind of press is good press, this kind of press for those companies has to be very concerning.

O, i would like to add, that someone from that link mentioned that congress has giving the upper hand to big business. This is very true as we all know, but i truely feel that is because not enough people have been fighting back. it's true, it cost alot of money to go through the courts, but if enough would start taking on that cost, maybe that itself will change. i mean someone will always pay, but if enough people contest, it might be possible to off load the entire court cost onto the plantiff.

I definately think the riaa should rethink thier strategy here... if you know what I mean ;)

sorry, but that line make me lol :) to think that a company can be communist at all... what with being the cornerstone of capitalism...

but yeah, good luck to her. i'm glad someone's stood up to the bastards. i hope this inspires many, many other people to take on the IP cartels.

I have a feeling this suit might not amount to much, but there is a possibilty that it could have a huge impact. One of the things drawn into question is the RIAA's use of John Doe suits to subpoena isps to divulge customer names, so they can then sue them under their proper names. If the court rules this an abuse of the discovery process than the RIAA and MPAA and BSA will effectively be barred from suing file sharers entirely. I can't think of any other way they could possibly track file sharing and then get those users names.

I admit I don't know much about P2P protocol but I don't really see how they "hacked" her. She (or whoever was using her computer at that time) was broadcasting the ip address and file list to anyone that cared to look. There's already a US court ruling saying that you have no right to privacy in your ip address or file list when on open P2P networks. And all the previous RIAA suits have used nothing more than these logs to file the John Doe suit and get their names...after that they can simply subpoena the info from her hard drive. I don't see what hacking her would even accomplish, being in possession of, say an mp3, isn't even an infringement. And they supposedly deleted files? What would that accomplish? Her petition even states that the illegally obtained information was supposed to show her actually distributing the files...well that's the P2P logs, what else could it be? Anyone else on the P2P network can look at those.

Files are disappearing from her hard drive.... her internet connection is being used to download gangsta rap but there's no way she did it...hello? The logical conclusion is that some 3rd party hacked her and used her connection to download these files for themself. That's why the RIAA sued and that's why her computer was compromised. It makes sense to me anyway. If she's running a wireless network in her house I'd put money on it.

Sorry. Most of the points of the lawsuit will be laughed out of court. She'll be lucky if even one of them sticks, let alone get a result that would force the RIAA to significantly change its behavior. A lot of her points weak. But, even her good points don't matter much when it's a pro-bono(?) lawyer up against a giant, and very experienced beast.

**RAMBLE ALERT** **RAMBLE ALERT**

it's not the essential need of winning the whole shabang or any of it, it's the publicity of a case like this that strikes interest in many. For instance, before this, what private citizen have you heard get in the ring? All the ones i have heard of have just thrown in the towel. if a large amount of lawsuits are brought up with the same amount of fury she has, then to keeps these things "hush hush" to stop scrutiny from the RiAA's tactics will be very hard, if not impossible.

in my opinion it's "MegaCorp" caring for the almighty buck and not humanity that has to stop. However at the same time, what also must stop, is the lack of fighting back against these monsters here in the USA that feel they can just rule the "Global Market" with the boots they feel fit the best. i'm not saying everyone is financially stable to fight back alone, but maybe in a team/organization. The USA has become the most powerful country in the least amount of time than all others in history. This is because many people have died in the last 229 years to make it this way, let's not let this happen too much longer.

To be serious and very honest, i have a job now and a outlook on my future that i will make happen. if any of you here at this forum, or any of the forums you visit run into the RiAA, i will be happy to setup a donation. i not sure if anyone is strong enough to fight back alone, but in numbers we can fight. This sounds radical, but the very proof of someone going to court in front of a jury funded by hundreds, if not thousands of people in the country, could yield fire. if this happened, in ways, it would be more than one voice in that court room.

i could donate safely 500usd to this cause (i got a few friends locally i could get to match that), get a thousand people in that range and you have a chance. if you're in the continental USA i could even fly out and protest infront of the court house given enough time to register the paper work for that. Might sound strange giving 500usd to a stranger to help them, but this would help us all.

i'm just so god damn tired of seeing people get trampled on by "MegaCorp" in this country. it's of course is not just present with RiAA and company, but MANY aspects of our crumbling market. This keeps up, there will be another great depression. And who gets richer in depressions? The Mega-Rich.

i will hold my post here as a bond to myself so no matter how out of touch i get in the future, i have a debt of 500usd to this "John Doe". Organization, it's what they have, that we don't.

That's a good point, but is that a reason to hide, or look the other way? Some might be comfortable now, but many gave up alot so many could be as comfortable as they are now. What do we do? Do we wait until we all no longer feel comfortable to do anything, or do we ensure that comfort with action? Doing nothing only insures what it is...nothing.
