but can anyone point in the direction of a scanner that scans a vob file and give me the avarage bitrate

DVD Lab has a built in bitrate scanner. You can get a trial version at: http://www.mediachance.com.
And you can download a free version of the Bitrate Viewer here: http://www.tecoltd.com

ive tryed 2 d/l bitrate viewer seams 2 only d/l email effets (Strange)
now dvd-lab what one should i get the studio version or the authoring version

First: I can download the Bitrate Viewer 1.5 from the tecoltd site without any problems. Cannot reproduce your difficulties.
Second: Even the DVD LAB standard version 1.31 has the build in Bitrate Viewer.

Your tool looks promising.
But I have tested it on a mpeg stream muxed by MuxMan without any error messages.
Duration Difference from Video to Audio = -670008 msec
Result: Compliance Test: Fail!!
I don't trust this result...

Instructions from the program author:
To obtain a proper diagnostic you need, before analysis, set up the configuration file: MPEGReference.ini
The values of all parameters follow the ISO 31818 spec. For example:
Frame rate = 29.97 is represented by: 'FrameRate=4'
An aspect ratio of 16/9 by: 'AspectRatio=3'
and so on.
If you don't change MPEGReference.ini will obtain as resutl: Failed! every time.

PS: This version of MPEG Validator only support MPEG legacy media, ie, audio AC-3 give us: NO AUDIO
