How are you determining that the bitrate is above 40Mbs? BD Rebuilder already has code that limits the average bitrate in the command line -- and the maximum (--vbv-maxrate) is always set to 35Mbs or below (occasionally the combined audio bitrate drives it lower).
If you're seeing spikes above 40Mbs, I'd have to believe there may be some glitch in X264's limiting algorithm. A player should be able to handle spikes through it's buffering, but they have to be very short.
