Nero Digital 9.8Mbps?

I am assuming this is using H.264 AVC codecs correct? Anyway to use this high of a bitrate using Recode the way it is now? It looks like the limit is 4Mbps.

understood but how did they get 9.8Mbps for a bitrate when the highest the Recode application will let you select is 4Mbps?
