Despite 321 Studios’ best efforts to remain in business, injunctions entered against 321 Studios by three US Federal courts earlier this year has resulted in 321 Studios no longer being able to continue operating the business. i'd always wondered, if i product is no longer be manufacture, and the company is out of business, is it legal/wrong to download a warez version of the software?

I believe it comes down to the question who will have the copyright for the manufactured product in question, lets say product A.

If no copyright remains for product A, you cant be infringed or sued or whatever.

Also, in very few cases can single users be held accountable for issues of big companies so mostly there will never be a legal problem anyway (besides, how should someone find out? Noone may enter a room without permission or a granted right by courts to do so.)

But then again, lawyers will surely try to twist situations.

hmm... it was a brave fight i suppose

but to be honest, i doubt 321 studios were all that commercially viable anyway. the courts may have sped up the process, but i don't think 321 studios would have survived, even if left unmolested.

No, it's not legal. The copyrights still exist and for 321 Studios, the copyrights will exist until long after you and your children are dead. Someone will retain those rights unless that someone hands the rights over to the public domain.

On the other hand, I doubt there will be anyone to enforce those copyrights. And, if the software is illegal then the copyrights would be invalid.

It couldn't have happened to a better company... They brought too much heat to the whole DVD Backup area anyway... They accomplished NOTHING for the cause... and gave the STUDIOS an education about the tools we use... They even SUED FIRST to gain control over which court to have their fight in...

I am GLAD they are gone... Been looking forward to the day for a long time... Maybe Derrow will come back and develop something worth the wait...
