It has been tacked on to the MPEG4 specs IIRC. As to it being free or not. Well it is someones intellectual propperty. I have very little hope for it being truly free in this instance. There are however opensource projects now under development based on the demonstration code and Xvid code being developed. This was recently announced in the general forum if my memory serves me correctly. They might be able to find a loophole for distribution as Xvid did. Divx is not truly free. Someone pays for it. For full legitimate distro this will be similar. It is impressive though.

Yes, there is an opensource project underway, at:
http://hdot264.sourceforge.net/
Like xvid, this is all about experimenting with the standard, not about making a codec for general use. There will certainly be no binaries on the website because there may well be patented technology in the codec.
There is now sourcecode for a VfW codec, which works well (but very slowly). Grab the source from CVS, build it and have a play - and perhaps you can help speed up the code!!
