Divx5+ogm= few bad frames

i guess divx5 in ogm produces bad frames (about 20-30 on a 2 hour long movie)
I would say this is a known issue.
I would like to know if anyone knows who's fault is it (ogm or divx5)
and if there are people working to fix it.
